1. We are here to inform you, enlighten you, encourage you, and hopefully help you discover new ways to assist in your pain relief. This site is a public arena and there is no confidentiality (except in scheduled personal consultations). The content or questions you write in e-mail letters and through our "Contact Us" page all go through the Internet. Be aware that like most e-mails that you send and receive, there exists a remote possibility that your message could be read in transit. Only the correspondence you send in the personal consultation section is fully secure.

2. If you do raise an issue that gives us concern, we are legally responsible to attempt to report any suspicions of your intentions, such as that of child abuse. Also, if you lead us to believe that you would harm a child or a dependent adult (often an elderly person under care) we are required by law to make a diligent effort to report it to social services, the police, or both. We are legally responsible to attempt to report if someone's life is in danger, such as suicide or homicide. We strongly urge you that if you feel or think you are actively considering suicide or harming another person that you please find a local professional who is trained and licensed to help you.

3. Most U.S. courts have the power to subpoena our records if they determine they are relevant to a case. If you have any questions, please speak to your attorney prior to disclosing private information online. E-mails may be admissible in divorce courts and other legal proceedings.

4. While My Back Pain Doc consultations are not psychotherapy, the counselors who work here are mandated reporters of child and dependent adult abuse as well as intent to harm oneself or another. Laws vary from state to state and country to country. Since our company is located in California, we will make every effort to conduct ourselves in a respectful and professional manner that is in accordance with the laws of the state.

5. Refund policy for private consultations: Refunds will only be granted in the extraordinary case where for some reason we were unable to reply to your e-mail communication, or you failed to be available during a scheduled phone consultation. Since our responses are our best attempts to provide a qualitative answer, we will not refund your money if you do not agree with our response, or if you are not be pleased with our response. We promise to do our best to give you as thoughtful a response as we can in the space provided. Certainly we realize we will not always answer your questions to your complete satisfaction. Should you feel our response is inadequate, we would encourage you to write to us and tell us why. However, we will not refund your payment.

6. The e-mail addresses that we collect through our site are obtainable only when you choose to "opt-in" to our newsletter notification mailing list. We do not share or sell your e-mail address or personal information. Period.

To protect your individual confidentiality and to keep your on-line experience safe, we offer the following suggestions:
Use a screen name or your first name, last initial when a response to your question will be displayed on our Web site.

If anyone other than yourself has access to your computer, make sure they are not able to read your private e-mail messages or any files stored on your computer's hard disk or back-up disks or CDs.

If you print your e-mail messages, we suggest that you store them in a secure place that is not accessible to prying eyes. Should you be writing to anyone at our site from your workplace computer, be aware of computer fraud protection, wherein your employer has a legal right to read your e-mail messages on that computer, and that most employers maintain disaster recovery back-up systems that have already recorded your data.

Pay particular attention when sending us an e-mail message. It's preferable to submit your inquiry through our  "Contact Us" form on our site rather than sending us a personal e-mail from within your own e-mail system. Our reasoning is that if you use your personal or business e-mail program, and click on an incorrect name from your address book, someone else could receive your private information rather than us.

Please be aware that while we make certain recommendations of products throughout our site, we take no responsibility for the products themselves. Hopefully, should you decide to purchase an item it will be a valuable experience for you, but know ahead of time that we cannot promise that the quality of the services delivered will be acceptable to you.
